A U.S. judge has shot down Apple’s request that Amazon stop using the word “Appstore” to describe its mobile application marketplace. Apple originally filed a lawsuit against Amazon in March of this year arguing that Amazon’s “Appstore” infringed on Apple’s “App Store” trademark. Amazon immediately responded calling the claims “baseless,” and now the court has taken its side. “The evidence does show that Apple has spent a great deal of money on advertising and publicity, and has sold/provided/furnished a large number of apps from its App Store,” Judge Phyllis Hamilton, said. “However, there is also evidence that the term ‘app store’ is used by other companies as a descriptive term for a plac...

Judge Phyllis Hamilton, who is presiding over the Amazon-Apple “app store” war, certainly meant it when she said she would “probably” reject Apple’s request for a preliminary injunction. And that’s exactly what she did. Hamilton earlier referred to Apple’s proof as a “stumbling block” in its case against Amazon, noting that there isn’t much “evidence of confusion” between the two stores. In an 18-page order, Hamilton explains that Apple has not proven that its App Store is “prominent” and “renowned,” which I guess it has to be in order achieve the status necessary for shutting down Amazon’s Appstore for Android.

California just became the latest U.S. state to sign the so-called "Amazon tax" that will enable it to start collecting sales tax from online transactions. The move will likely trigger a response from Amazon, which has made it clear that it will stand its ground against what it considers to be an "unconstitutional and counterproductive" measure that interferes with interstate commerce.

Amazon will soon place initial component orders for its upcoming tablet, which is slated to launch in the second half of 2011 according to a new report from DigiTimes. Citing anonymous industry sources, the report claims Amazon’s initial order will likely fall in the 1.5 million to 2 million-unit range, and the retail giant is expected to take its first delivery in September. The Mac mini is once again in short supply, observers point out. At the Best Buy US website the device is now listed as backordered, with a shipping time of one to two weeks, although pick-up should be possible at some stores. Amazon UK is also listing the computer as backordered, though with a specific resupply date of July 5th.
The shortages support the notion that updated Mac minis may be imminent. As new hardware approaches, Apple tends to slow and then cease production of the previous generation. The widespread expectation for the Mini, however, is a late July or early August launch date.

This app is sort of interesting, but the concept is certainly not new. There have been online grocery shopping services before and they have all eventually gone under. Remember that whole trademark tiff between Apple and Amazon over the generic or non-generic term “app store?” Despite going quiet for the past month, the case is certainly not over, although statements made by U.S. District Judge Phyllis Hamilton suggest that Apple may be losing steam in its fight.
She referred to Apple’s proof as a “stumbling block” when the company argued that the stores’ similar names – Apple App Store and Amazon Appstore for Android – could cause confusion among consumers. For months now, DigiTimes has been fueling rumors of Amazon's first foray into the LCD tablet market. Today it ratchets up the specificity with sometimes contradictory claims that Quanta Computer will be responsible for assembling the tablet with a supposed TI (not NVIDIA) processor and Wintek (not EIH) touch panel among its components. According to DigiTimes, Amazon hopes to move some four million units in 2011 alone with plans to launch the new tablet as soon as August. Possible? Sure, likely even. But we'll wait for Bezos to sing before updating our holiday shopping lists.
